Court Disagrees – FDA Cannot Ban E-Cigarette Imports

Accusations that the FDA was being influenced by big tobacco began to circulate with the first FDA statement questioning the safety of electronic cigarettes. The statement was based on an extremely small non-scientific test and claims made were that various problems “might” be encountered by users of e-cigarettes.
We have known for over 40 years that smoking tobacco is a serious health danger. It was then that warnings were added to cigarette packs yet the U.S. now has one of the weakest warnings used globally. After forty years of proof of the dangers in tobacco, the FDA moved in 2009 to regulate the tobacco industry. You may be surprised to learn big tobacco conglomerates welcomed this new regulating effort. Of course they did. The regulations are likely to be based around their current practices and a result would be to make it far more difficult for a competitor to enter the marketplace.
After various expressions of concern, the FDA banned importation of e-cigarette supplies from China. The ban was imposed in 2009 affecting the world’s biggest exporter of e-cig supplies. When announcing the ban, the FDA claimed concern that underage users would be tempted by flavored e-liquids and become addicted to nicotine. No proof or studies were offered as evidence for this concern.
In a decision handed down by a Federal Judge on January 15, 2010, the FDA was ordered to lift the import ban that affected electronic cigarettes. The FDA was criticized for aggressive efforts focused on turning a recreational product into one designated as a device or drug that could then be regulated out of existence.
Pointing to the newly established tobacco division created within the FDA to regulate tobacco, the judge stated that the same regulations could be applied to electronic cigarettes and supplies.
Responding to the court decision, the FDA seemed to change it’s reasoning about an import ban claiming concern over potential “health issues”. The previous concerns of underage smokers seemed to be forgotten. If the FDA appeals the court decision the agency will have full support of big tobacco.
The costs of electronic cigarettes would increase greatly should the FDA be allow to set standards and restrictions on the products. Big tobacco currently cannot compete with the lower cost of e-cigarettes.
The court decision defined a need to scrutinize the relationships that exist between tobacco companies, pharmaceutical concerns and the FDA. Taxes from the sales of tobacco products put billions of dollars in federal and state government coffers annually. Many of the attempts to create fear of electronic smoking alternatives seem to be more concerned with the financial bottom line than with the protection of public health the FDA is charged with. Had big tobacco been the industry that introduced and promoted electronic cigarettes it is doubtful a controversy would exist.
Why has a ban on the use of tobacco never been a topic of conversation within the FDA? Why would a government agency designated to determine the safety of products sold to the public focus on attempts to ban a product before conducting scientific research? The method I decided to try was a simple, home lung detox which cost me around $30. The idea behind it is that it fast tracks the removal of chemicals, tar and toxins that have collected through your smoking habit. This in turn speeds up the the bodies natural repair of the lungs.
The lung detox was surprisingly easy to do but the effects were quite staggering so if you are thinking of doing it then prepare yourself for a shock. I expected to have some evidence that my body was getting rid all the gunge in my lungs but didn’t expect it to happen so quickly and, I hasten to add in such volume. It was a real eye opener to see just how much tar I had in my lungs after 12 years of smoking. It’s also a side effect to feel mildly sick but that passes after a day or two. What I wasn’t aware of that it can take anything up to 15 years for the body to break down the tar and toxins naturally. I don’t know about you but that is way too long for me to wait!

The strange thing is in the early stages of lung repair it’s very usual to get a cough for a few days This a quite normal and it is also a sign that the lungs a re beginning to repair themselves. The cause of the cough is simply the tiny microscopic hairs known as cilia starting to do their main job which is sweeping out toxins, dust and particles from within the lung tissue. So this is why the mucus that you cough up will be discolored. The other cells that are damaged by smoke are the alveoli and these can take longer to repair. In fact there are some specialist doctors who believe that the alveoli never regain the same level of health in an ex smoker as that of someone who has never smoked. What I will say is that I’m convinced tha a lung detox has helped me in my quest to quit smoking for good.
